One one hand you have folks who are getting labor approvals from BECs just now and have not filed I-140s.
On other hand you have PERM folks who have Labor, I-140 certified in 2 weeks.
Don't you think this provision is a bit harsh on those who've waited 3+ years for labor in BECs ?

>> Although 30,000 people are IV members
Update:
18,344 members have zero post.
21,807 members have zero or 1 post.
27,370 members have zero to 10 posts.
That should give an idea how many members are really "active" on IV.
Though IV core is doing a wonderful job as volunteers, no wonder why there is why there are only few active participants. I have asked my friends to join IV (some of them already joined during '07) they say that it is occupied by few senior members and anyone speaks against them or come up with any suggestions, they will
--> update the profile ( I feel that they should update)
--> contribute time and MONEY and there are many seniors who do not update their profile and still didn't donated a dollar....
--> If you speak up loud, you are an anti- and criticize until you leave the thread...
They say that it has become hangout joint for few and they rule...no suggestions from new comers are entertained here...IV is just depending on CIR which is known to fail from all fronts and IV is not working towards smaller bills....

http://travel.state.gov/visa/frvi/bulletin/bulletin_4252.html
EMPLOYMENT SECOND PREFERENCE VISA AVAILABILITY
There have been questions raised regarding the way numbers have been provided to the China and India in the Employment Second preference categories beginning in April. Section 202(a)(5) of the Immigration and Nationality Act states that if total demand for visas in an Employment preference category is insufficient to use all available visa numbers in that category in a calendar quarter, then the unused numbers may be made available without regard to the annual per-country limit. (For example: If the second preference annual limit were 40,000, number use by All Other Countries were estimated to be only 25,000, and the China/India combined number use based on their per-country limits were 6,000, then there would be 9,000 numbers unused. Those 9,000 numbers could then be made available to China and India applicants without regard to their per-country limits.)
Based on the informaiton available, it was been determined that the demand from All Other Countries for Second preference numbers, plus the amount of numbers available under China and India Second preference per-country limit, would be insufficient to utilize all available numbers under the annual limit for this category. Therefore, pursuant to Section 202(a)(5) of the Act, the unused numbers have been made available to China and India Second preference applicants. Since Section 203(e)(1) of the Act requires that such unused numbers be made available strictly in priority date order, the China and India applicants have been subject to the identical cut-off date. As there are more Employment Second preference applicants from India and the Indian applicants may have earlier priority dates, it is likely that Indian applicants will receive a larger portion of the available numbers than Chinese applicants.
It should be noted that the Employment Second preference category is "Current" for all countries except China and India. If at any point it appears that demand from All Other Countries would utilize all available numbers, then an adjustment would be made to the China/India cut-off date. Therefore, providing the unused numbers to China and India in no way disadvantages applicants from any other country, and helps to insure that the worldwide annual limit can be reached.
EMPLOYMENT THIRD PREFERENCE VISA AVAILABILITY
Demand for numbers, primarily by USCIS for adjustment of status cases, will bring the entire Employment Third preference category to the annual numerical limit by the end of June. As a result, this category will become unavailable beginning in July and will remain so for the remainder of FY-2008. Such action will only be temporary, however, and Employment Third preference availability will return to the cut-off dates established for June in October, the first month of the new fiscal year.

People, since Aman and lets not forget other core members also (who I am sure have racked up a lot of out of pocket cost) we as a community should gather funds for administrative cost also. GC is not just Aman's/ pappu/logiclife and others core member's dream...its OUR dream, and its not fair that in spite of knowing the time and money spent by the core members we donot share the burden.
So here is what I am thinking, there are 21000+ members of which I think 10,000 can be considered the real people (I am sure there are more..but a real conservative estimate) if we all pitch in $10 for administrative cost I think it would not put any dent in our pockets and this collective effort would not create a financial burden on any of the core members.
Any thoughts!

Gandhigiri approach to retrogression in my opinion will be to do some good deeds that give Immigration Voice positive publicity, which in turn pushes the retrogression debate in the forefront in the national press.
There are several positive things that IV could do:
1. Start a small scholarship in a poor/immigrant dominated school/neighborhood.
2. Help some hospital in a poor/immigrant dominated.
3. Have a blood camp.
4. Donate food.
5. Send flowers to Senate & House.
Guys, all we need is positive publicity. We do not need large sums of money to do this.

lonedesi,
I saw your post last night and have some changes in mind for the NSC letter. But right now I'm working on having the 7001 piece out from my employer - hope others are doing that as well.
Thanks again for the initiative - Its always better to speak up about your pain rather than remaining silent.
Thanks!
Members, who were complaining about the slow processing of I-140's at TSC & NSC, now is the time to stand up and get counted. Please take the time to review the letter and then mail the DHS Form 7001 along with the letter to USCIS Ombudsman's office.
Members who have already done so, please encourage others suffering from these delays to join this campaign to make it effective. Also, please post on this thread once you have mailed the letters, so that others get motivated to join.

Is there no one here who has a few $ to donate to the organization that gave them so much back, just think about how lucky some of you were to be able to file 485 last july! That alone should be enough reason to donate! Please, please give back to the community that gives you so much in return!
Do what you can
At least do the action items and call the representatives.
Thousands of legal immigrants waiting in EB queues and yet we can't reach even $20K. Let's change this perspective. Please donate in your good conscience.
Thank You.

With this model can IV still claim to be a non-profit organization? It seems you are exchanging information in return of cold hard cash? :p
Being a non-profit does not mean everything is free. Even some of our profession's organizations are non-profits and they want subscription to even login to their site. We are being very generous and providing everything for free and we will continue to do so to provide free access to immigrants on our site. Only a small donor area is for donors so that such members can have easy access to information and admins.

How about if we frame a well thought out letter..and present facts and start mass mailing - maybe once a month - every month. That we they will hear from us every month - in bulk.
How about if we dont use words like bonded etc and just repeatedly request the system to be repaired. Use of words like bonded etc can send a wrong signal.
We can also add our stories in there to give that emotional/human touch - eg. I can say that I have been in this country since 1999 and still waiting. If I look at my W-2s from 2001 (when I started working), I must have consistently paid about 10k in taxes to the Federal Govt and another 3k to the State every year. that makes my tax contribution to about 90k-100k in 8years..I think thats huge and I am still waiting, for being a tax paying and law abiding citizen just because the Immigration system is broken. I am a recruiter and I recruit US Citizens in large numbers for large govt projects, offering them really high salaries - while I am helping them "indirectly" realize their American Dream - my dreams are nowhere in the horizon. My wife works in the Child Welfare System and she helps broken families get back on their feet - while she is putting together their broken families - our family is still stranded in the system with no sign of moving forward.
Just a passing thought! I thought I should run this by you all. Thanks for reading.

seriously , I have seen a couple of people who day dream unrealistic thing and for some time
thinks thats true. This normally happens, when you normally facing a lot of negative things then your mind things of all the good things,( in your shit load of money on stocks and investments). This actually helps keeping one out of depression in the illusional state. but unfortunately fact is fact.
As far as I know, I am pretty aggressive in investment and I am getting @15% right now.. which too in a very unconventional ways.. by investing in forex and start ups with a risk of loosing nearly 80% of the investment in a day. when you 100K-200K and get returns like 100k.. dude that 100%-50% investment.. please let me know where can I do that.
I promise I gonna leave everything and go back with my money make investment in that and live the rest sipping feni by goa beach.

The numbers are assumptions and NOT facts. Most of these numbers have actually been pulled from other places or based on some rationale (for example 750,000 from Matthew Oh site, 5 minutes/EAD based on what need to be done to print out a card and pack in an envelop)
Workforce of 30 though is a gross assumption. Bigger the number better it is. So we may actually want to question USCIS if there are any resource constraints.
Outsourcing is a perfect Idea! What do you have in mind Wipro at Banglore? :D
What about receipt notices? Isn't that teh first step? I do not believe it will take 20 months to get a receipt notice. Are you sure they have only 30 folks for EAD. Is that a known fact? What if it is 300?
How about outsourcing it?

I was in same dellima couple of months before. I was working as a permanent employee in USA but company was not doing good. My PD is feb 08 in EB-2. I weighted all options and decided to move back. Tried in couple of places and within 3 months got a good offer. Now working with world top 10 employer at bangalore as a Project Manager since Nov 09.
I am happy with my decision as of now.
I suggest its not worth waiting 10 years for GC. Life is more to be lived than to wait for GC.
