    My PD is March-2003 and I didn't get the labor cleared till Late 2006

    I just can't help wondering how did you get your labor in 2004 with the PD of May-2003? How come snake of BEC didn't bite you? :)

    Prior to BEC, the Labor certs need to clear the state and then regional processing center. Stated like NJ, NY, CA, etc the wait time for Labor was years, while Iowa, MA, etc cleared labor in few months and many lucky folks got the GC from start / labor to 485 approval in 15-18 months... The unlucky ones (me included) are stuck now even with earlier PD in AOS... Hope something good happens in second half of FY09 atleast.... for all

    It is not even considered yet and I don't think it will ever be considered. That amendment includes not only schedule A but also others and with proposal to increase the number as well.

    How could it pass if it's carrying heavy-baggage, it won't move!!!

    What if out of all 10000 , 9999 don't have priority date current.Do you think they will still not look at the 1 in the pile which has a current PD.They will look at it , Even if it is number 10000 in the list.Actually there will be no pile because 9999 people won't even be in contention.
    Why do you think labour substitution was so HOT?Just because by getting an earlier PD , you were going to steam roll everybody who filed before you , just because you got an earlier PD..

    In your case you will get the percedence over the 2001 PD. His is PD is not curent at time of processing. If the cut off date is after 2002 which means both are cuurent then the later guy will take precedence since his RD is earlier than your's.

    i sent all documents to loan officer at wells fargo for refinance. I sent I-140, EAD copy for immigration documents. just got email from loan office that he received my file back from underwriter and ask for greencard copy front and back as underwriter said EAD is not acceptable (Employer can not sponsor borrower).

    could anybody please tell me what to do now?

    May be they approve loan for only people who run away and screw up economy.

    Try with a different bank.

    There are many who bought home with H1B visa.

    My street has 3 people who are in H1B (not even 140 approved) and great homes.

    can you please suggest accountant, if its ok with you, residing any place is fine as we deal most of it through ph, having tough time to find the right one just to aid in the start up and maintain min. proceedings like tax filing etc. without having any activity/revenue

    This is not true in most cases. The F1 might be for 2 yrs minimum + 1 year EAD + at least 2 yrs on H1B before the GC process starts. Then its 7+ years...
    So overall, we are talking 10+ years to get permanant residency in a majority of cases.

    Are we just talking about 2 yrs to see if there is going to be some reform?

    If you don't want to get into the trouble of debating how many years, just say that it is unreasonable....

    Nice to see something other than economy down, GC crisis. How your wife manage to do all this. I have two sisters and both are working hard to feed their in law, even before marriage their mother in law asked for giving 20% money to her son (doctor), so he can study, arrange all facilities for him.

    So I am really not understanding how your wife can do all this to you? My sister's shoul take lessons from her.

    In a weird way, I feel this is good news. An old saying in China says 'Things will turn to their opposite at their extremes'. The moment before dawn is the darkest hour of the day.


    I agree. Since politicians have no incentives from helping our cause, it has to come to an extreme breaking point when USCIS/DOS or politicians take any action. I think we have reached that point and that will help in highlighting the mess we are in.

    Its not a rumor. This is real. Coming to think abt it, he had filed a labor in 2000/2001 time period and had abandoned it when he switched companies. I am wondering if USCIS takes the oldest one an applicant had ever filed.

    I think the at the heart of this kind of reckless, selfish 'crusade' is a problem with poor upbringing. Some kids are brought up to look at the world through myopic self-interests, and are molly coddled by their parents into believing that their narrow views are indeed honorable and respectable.

    The sad reality is that such 'crusades' do nothing more than unite those against the larger cause of brown/black/non-white immigration and divide those that are already in pain.

    No wonder then that history repeats itself ever so often when those from the 'great Eastern lands' can so easily be ruled by those with shorter histories and accomplishments.

    Take a look at illegal immigrants. They break the law. Yet, they are able to unite so effectively to make themselves heard. For a group that has absolutely no locus standi for legal or political relief, they are amazingly effective in shaping the dialog around their interests.

    As a strategy and communications professional (with a strong background in Harvard Law School mediation/negotiation and US public policy) I can vouch for the effectiveness of a united voice that speaks to larger interests oriented towards US economic gains. These kinds of narrow sub-optimal "causes" only make the USCIS and the larger establishment care less about legal employment based immigration.

    Absent in this dialog from this 'erudite PhD' is analyses of root causes of underlying problems. For one, there is the absolutely crystal clear problem with country based quotas for employment based immigration in a country where the primary act, i.e., employment itself cannot be discriminated based on national origin. And so on and so forth.

    Instead of taking cause with such short sighted and self-centered acts, why not apply your collective 'high skills' towards highlighting the POSITIVE CONTRIBUTIONS of legal immigrants and pushing for a better overall process?

    Instead of collecting money to slit the wrists of those around you, why not join hands and petition the lawmakers for better, more transparent processing estimates?

    Instead of trying to make a futile argument that EB1 > EB2 > EB3, why not attempt to have a real public policy dialog that reframes larger interests?

    Further more, dont forget that when the USCIS needs to respond to such frivolous lawsuits, it costs US taxpayer dollars... which further alienates the USCIS and Citizens from the cause of legal immigration.

    No wonder then we find an increase in backlash against non-white immigrants that seek a higher sense of entitlement... seriously... I can bet just as I did with that SunnySurya joker a while ago, put your EB2 petition up online and let us see if there really is no US Citizen available to do the job.

    What makes it fair for a foreigner like you to come to this country and claim that there there is NO ONE to do the job based on which you seek to immigrate?

    If you are really serious about US national interest and the larger question of fairness, it is only fair that you post the EB2 job and we confirm that there is no US person ready and able to take that job. And dont try those advertising tricks, I will hire a lawyer to smoke out your games.

    BTW, I will be looking out for this lawsuit. I will get the details from you directly without you even knowing about it. Heck, I will even contribute to your "cause" so that you give me the details. Then, I will file a separate petition to have your specific EB case investigated for the merits your lawyer posed. Ready for that game?

    Bottomline, I blame poor parenting for creating such characters in society that cause a drain on the moral fabric of humanity.

    I was in same dellima couple of months before. I was working as a permanent employee in USA but company was not doing good. My PD is feb 08 in EB-2. I weighted all options and decided to move back. Tried in couple of places and within 3 months got a good offer. Now working with world top 10 employer at bangalore as a Project Manager since Nov 09.
    I am happy with my decision as of now.
    I suggest its not worth waiting 10 years for GC. Life is more to be lived than to wait for GC.

    APPENDIX: REFORM SOLUTIONS

    The Need for a Compassionate Visa

    A compassionate visa is immediately required for reasons of humanity and dignity. Currently, because of the technicalities of US immigration laws many families torn apart are also subject to more degrading treatment at times of severe illness. Any provision should allow for the following:

    * US residents, including those who are landlocked, to leave the USA for any necessary period for compassionate reasons;
    * Non-US residents to enter the USA for any necessary period for compassionate reasons on a nonimmigrant basis;
    * Evidence of immigrant intent should not prevent a person receiving a compassionate visa (such as an existing immigrant petition), unless an applicant makes it absolutely clear their intention is to immigrate and not to enter the USA on a temporary basis;
    * To prevent abuse of such a visa, documentary evidence should be required as appropriate to ensure the application is made in good faith; and
    * Compassionate visa processing should be dealt with the USCIS for US residents and in the consular office for non-US residents on an expedited basis if the imminent death of a close relative or funeral arrangements for a deceased relative is at issue.

    INA, section 203(h) (as inserted by the Child States Protection Act, section 3) (8 U.S.C.1153(h))

    �RULES FOR DETERMINING WHETHER CERTAIN ALIENS ARE CHILDREN-
    (1) IN GENERAL- For purposes of subsections (a)(2)(A) and (d), a determination of whether an alien satisfies the age requirement in the matter preceding subparagraph (A) of section 101(b)(1) shall be made using--

    (A) the age of the alien on the date on which an immigrant visa number becomes available for such alien (or, in the case of subsection (d), the date on which an immigrant visa number became available for the alien's parent), but only if the alien has sought to acquire the status of an alien lawfully admitted for permanent residence within one year of such availability; reduced by
    (B) the number of days in the period during which the applicable petition described in paragraph (2) was pending.

    (2) PETITIONS DESCRIBED- The petition described in this paragraph is--

    (A) with respect to a relationship described in subsection (a)(2)(A), a petition filed under section 204 for classification of an alien child under subsection (a)(2)(A); or
    (B) with respect to an alien child who is a derivative beneficiary under subsection (d), a petition filed under section 204 for classification of the alien's parent under subsection (a), (b), or (c).

    (3) RETENTION OF PRIORITY DATE- If the age of an alien is determined under paragraph (1) to be 21 years of age or older for the purposes of subsections (a)(4) and (d), the alien's petition shall automatically be converted to the appropriate category and the alien shall retain the original priority date issued upon receipt of the original petition.''

    Explanation

    The references to �(a)(2)(A)� refers to principal beneficiaries and �(d)� refers to derivative beneficiaries. Subsection (1) provides a calculation to be considered a child under the family-based preference categories in light of USCIS processing delays. Subsection (2) describes the types of petition covered, ensuring beneficiaries, whether principal or derivative, are treated as a child under 21. Subsection (3) is another useful provision so that if the calculation of a beneficiary renders them over 21, they can retain the priority date of the original petition.

    Problems

    The language of this provision has rendered the provision open to ambiguity. Specifically, subsection (3) states the �alien�s petition shall be automatically be converted to the appropriate category and the alien shall retain the original priority date issued upon receipt of the original petition.� The problem is in relation to a derivative beneficiary (which is covered by this subsection) and is twofold. First, by its nature of being a derivative, a derivative beneficiary does not have an original application to speak of. Only the parent has a petition, which has caused the ambiguity. A Board of Immigration (BIA) decision did provide a common sense interpretation (Garcia, Maria T, File A79-001-587, June 16, 2006), but this is not binding on the USCIS and we know first hand that the USCIS has not consistently interpreted the provision in accordance with the BIA decision. Second, although the above mentioned BIA decision clarifies the provision also applies to F4 derivative beneficiaries, these petitions do not automatically convert. An F4 derivative beneficiary who ages still must wait for their Parent to file a new I-130 form, which is inconsistent with the language of the provision.

    Another problem is if the new proposed points system is implemented, any person who ages out will no longer have a direct basis for immigration. Instead they would have to qualify under a points system, which is not guaranteed. This new system would make the above provisions redundant.

    Many H1s like me have their non-working spouses on H4 visa who are not given SSNs. Do we not pay taxes ? Do we not pay Social security ? We do, and therefore we should also be eligible for the Stimulus package. Indeed my son is autistic and disabled but we are not eligible for any kind of aid but we pay tons of taxes and social security. It is highly non-justified think. I know people will argue a lot if it is compared to slavery. But it is a "modern form of slavery". Yes, we are in this country with our own will but that is what they are making use of.
