The USCIS, on May 18, 2009, once again provided an update on the number of filings for H-1B petitions for the fiscal year 2010 program.
It announced that it has received approximately 45,500 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. It continues to accept petitions subject to the general cap.
I can report personally that the most recent H-1B regular cap I-129 petition that I filed was filed on May 11 and it was approved on May 15 � premium processed.
Also, the USCIS announced that is has received approximately 20,000 petitions for aliens with advanced degrees, consistent with its prior update and it reconfirmed that it is still accepting advanced degree petitions because it assumes that not all the petitions it received are approvable.
It�s beginning to look like the cap isn�t going to be reached any time soon and, who knows, maybe not at all this fiscal year.

I know this must be a issue some of us would have faced. My wife's Birth certificate is in native language. I have got it translated from India on a stamp paper and notarized there itself.
Is this notarized paper a valid birth certificate for 485 ?

Hi Friends,
I have approved I-140 (PD Sep,2007) but recently my H1 extension was denied so had to come on H4, so now what will happen to my GC, do I have to start from scratch OR my I-140 is still valid once I come back on H1 (with different employer).

Are you referring to Silverlight? If so, there is currently no easy way of doing that outside of you manually breaking text apart into two separate text block entries.

The Government Accountability Office has released a new report studying the accuracy of the E-Verify database. According to the report, the number of tentative non-confirmations has decreased by 5% over the last two years, an indicator that the system has more complete records than in the past. The report also praised USCIS for instituting new measures to protect the privacy of employees and improve oversight of employers proper use of the system. I have MS+2 yrs of experience(software engineer). The company i am thinking to join is in Boston.
I am guessing boston is a highly educated town with many young graduates roaming around. Having said that, will this be an issue while we send out an ad for MS+2 yrs as there might be several responses to the ad and refuting all of them would be difficult ?
Please let me know, if I am THINKING CRAZY or this is TRUE. Another option i have is a company in chicago. Not sure where will I be better off as far as GC is concerned.
Also, anybody heard of MONIQUE KORNFELD immigration attorney based out of Newton, Massachussets ??? If so, please let me know about her expertise. I JUST can't find out how many yrs she has been practising immigration.

Hi,
I have changed to a new employer using AC-21 recently. I have pro-actively sent AC-21 documentation (new offer of employment, covering letter and supporting docs) to USCIS. Ever since, I am checking my case online. Its about 3 months now that I have sent this info and there has not been any update/LUD on my 485 case so far. I am not sure if my I-485 case has details about my new employment.
I am currently doing my EAD renewal. I am thinking if it will be possible to indicate to USCIS about my new employment. Can you please advice on -
a) if it is wise to do so?
b) How can it be done?

I have filed 140 /485 concurrent on Aug 3rd and haven't received any receipt. Have opened SR , Sent FAX ..but no updates.
As per the nrew rule implemented on July 16th , All the previously approved labor will expire on Jan 12 2008.
If for any reason we don;t receive receipt , what happens to labor.. Are we back to square one ..
If anybody in simiar situation... Please reply.

I believe some lawyers still do 245(i). The fee is $1k. Talk to an immigration lawyer or google "245 (i)"
