The Ranking Member of the House Immigration Subcommittee would like to deport all Haitians so they can help rebuild their country. Yeah, I'm sure that's what's motivating this "compassionate" proposal. Wonkette, the often hilarious DC gossip blog, has nicknamed King The #1 A@#hole in Congress for just this sort of rhetoric. ABC News quotes King: "This sounds to me like open borders advocates exercising the Rahm Emanuel axiom: 'Never let a crisis go to waste,'" Rep. Steve King, R-Iowa, said in an e-mail message to ABCNews. "Illegal immigrants from Haiti have no reason to fear deportation, but if they are...

I saw an update in my case status on July 10th.
It says, RFE received and case reprocessing started..what does this mean?
anybody else has seen this?
Did you get any RFE and responded back to USCIS?. Then your status will change like this.

Hello everyone,
This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -
1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?
2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.
3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?
Thanks in Advance...

My friend approved PERM in EB2 have qualification 3 year B.SC + 1 Year B.Ed + 2 year MSc. total 6 years of college, filed I-140 and was denied because of education. The labor is for Masters with 0-1 year experience. But they want 4 year degree prior to masters, citing EDGE database. Now the appeal is with AAO.
My question:
1. Do he can apply with the same labor for EB3 ?. What is the chance with two I-140 with same labor ?
( He filed I-140 for EB2 with that labor before 6 months of PERM certification. The PERM certified on April 2009 )
2. Or he need to do a fresh PERM with EB3 as a backup till the AAO verdict ? (takes 22 months)

"I'm having to deal with the reality of what is. You can't wish it away. What is, is." So says a glum Ohio Democrat, Governor Ted Strickland, according to reporter Laura Meckler in this weekend's edition of The Wall St. Journal ("Democrats Face Economic Facts: Updraft Unlikely"). Meckler's article reports on the prospect that Democrats "will lose their majority in the House," citing two nonpartisan election handicappers, the Rothenberg Political Report and the Cook Political Report. What would shared power portend for immigration reform if the GOP took control of one or both houses of Congress? Before that question can...

Some paras from Securing Iraq Votes, One at a Time (http://www.washingtonpost.com/wp-dyn/content/article/2007/03/10/AR2007031001300.html) -- House Democratic Leaders Methodically Build Support for War Plan
By Jonathan Weisman, Washington Post Staff Writer, Sunday, March 11, 2007
Rep. Jerry Nadler was the only lawmaker at a meeting of all House Democrats on Thursday to stand up and declare that he could not support a compromise plan to fund the Iraq war with a timeline to end the conflict. So some party leaders had written him off even as he joined House Speaker Nancy Pelosi for a private meeting.
In the confines of the speaker's suite, Nadler (N.Y.) could be specific. He sought assurances from Pelosi (Calif.) that President Bush would be compelled to withdraw all troops from combat by August 2008, as the legislation proposed. He wanted to know: "What is the legal compulsion to follow this timeline?"
A Pelosi aide disappeared from the meeting for a few minutes and returned with a few lines of legislative text offering what Nadler wanted to hear: Once troops are out of Iraq, no money would be available to put them back in, outside the narrow exceptions of targeted counterterrorism operations, embassy protection and efforts to train Iraqis.
"You know," Nadler said after a pause, "I think that's okay."
Nadler's conversion was a sign of the member-by-member, slow but deliberate headway Democratic leaders say they are making in their efforts to cobble together the 218 supporters they need to pass one of the most consequential pieces of defense legislation in decades, a $105 billion war-funding bill that would impose strict standards of rest and readiness for the military, establish clear benchmarks for the government of Iraq and set a timeline to end U.S. involvement in the war.
Through closed-door meetings, pep rallies, private phone conversations and horse trading, Democratic leaders are moving outward from the 180 solid votes in the party's political center to win the votes on the party's left and right that will be needed to pass the bill later this month.
The cajoling will continue tomorrow as lawmakers return to Washington and the legislation is readied for markup later in the week. But there are roadblocks: Rep. Allen Boyd (D-Fla.) said some conservatives are withholding their support until the language McDermott wanted is removed.
As Democratic leaders balance those demands, the calculus is fairly straightforward, said one conservative Democrat involved in the process. Leaders are counting on winning all but a dozen of the 43 conservative Blue Dog Democrats and all but a dozen of the 75 or so members of the liberal Out of Iraq Caucus. Then, Democratic leaders are hoping, enough Republicans will break ranks to put them over the top.
By last week's end, House Democratic Caucus Chairman Rahm Emanuel (Ill.) said, they had secured about 200 votes.
But the last 18 votes will not be easy. That point was brought home Thursday morning, during the closed-door meeting in which the legislation was detailed for Democratic members. As Pelosi gave her pitch, Reps. Lynn Woolsey (Calif.), Barbara Lee (Calif.), Lloyd Doggett (Tex.) and Nadler stood up to leave for a news conference of their own. After an uncomfortable pause, Pelosi growled that she wished Democrats would be courteous enough to hear her out before talking to the media. Nadler sat down. The rest walked out.
Democratic aides concede that some party members, including Woolsey, Lee and Doggett, are all but lost. But they are not giving up.
"There's nothing guaranteed in life, but I feel very good," Emanuel said.

The week's news dealt a body-blow to the prospects for comprehensive immigration reform, as if the movement to fix our broken immigration laws were blind-sided in a collision with a former pinup driving a pickup -- which it was. With the election of new Massachusetts Senator, Scott Brown, to take the seat of the late Ted Kennedy, the godfather of more humane and just immigration laws, supporters of CIR (Comprehensive Immigration Reform) are swallowing their sadness and putting on their game faces, saying there's still no stopping the CIR train from arriving at its destination. It's hard to maintain optimism,...

I came in on an F1 and got transfered to a H1B without leaving the country.
My H1 was approved for 3 years ie till 2012.
Due to problems at my work place, my H1 got revoked by my employer.
I'm in the medical profession, hence, jobs are few and far between if removed form a training program such as I was in. The next cycle of jobs dont start employment till July 2011.
I am currently within the 180 day limit.
What are my options? My countrys consulate is known to be tight fisted with visas, especially as I have overstayed since I lost my job abruptly.
If my fiance and I do get married, am I eligible for for adjustment of status?
Please help!

The Brookings Institute's Darrell West has authored a new book entitled Brain Gain: Rethinking US Immigration Policy which makes the case that comprehensive immigration reform is critical to keeping the US competitive in the 21st century global economy. From the Brookings description of the new work: Many of Americas greatest artists, scientists, inventors, educators, and entrepreneurs have come from abroad. Rather than suffering from the brain drain of talented and educated individuals emigrating, the United States has benefited greatly over the years from the brain gain of immigration. These gifted immigrants have engineered advances in energy, information technology, international commerce,...

If you're going to fudge the truth, you would think she would pick something tough to refute. From the Arizona Republic: Gov. Jan Brewer said in a recent interview that her father died fighting Nazi Germany. In fact, the death of Wilford Drinkwine came 10 years after World War II had ended. During the war, Drinkwine worked as a civilian supervisor for a naval munitions depot in Hawthorne, Nev. He died of lung disease in 1955 in California.
