People suggest to work for 6 months...Remember there is no rule to work for 6 months. But just incase if somebody ask at the time of applying for citizenship, you can show that you worked for 6 months.

Lets say, after getting EAD and AP and 6 months after filing for I-485, you want to switch jobs to another company but want to do an H1B transfer to a similar position. Do we still have to start the green card process from scratch to remain on H1B?

When applying for AP, do we need to submit separate cheques for AP($305) and Biometric($80) or we need to combine both ie., $385 and send as one cheque :confused: ????

Hello, My parents on B1 visa just entered the US a few days ago. This is their 2nd visit. I extended their stay beyond the given 6 months when they came last time. My mother got a 6 months term on her I-94 this time which is ok but my dad was granted only 60 days of entry and he said the immigration officer has marked in Black marker pen saying "No Extention" on his I-94 card. The justification they gave was that they were unable to find his previous extension, but if they were unable to find his extension, how could they even permit his entry in the first place since overstaying without extension would be illegal.
My question is with "No extionsion" marked in writing on my father's I-94, could I apply for his extension beyond the granted 60 days?
Please answer this question so that I can take the needed action.

Hi,
I have applied for I-140 in Oct 2006 and hvn't recd I-140 yet (Nebraska)
My 485/EAD checks got encashed today. My questions is do I need I-140 before FP or EAD card.

What happends if we don't get our checks cashed and no receipt after aug 17th, but the documents get returned.
Can we refile or are we out of luck? :confused:

My full 6 years of H-1B expires in Jan 2010. My labor will be filed in Jan 2009. I would like to go back to school full time on F-1 in Fall 09. At that time, I would still have 5 months of H-1B time remaining plus a priority date. After I graduate, find a job on a new OPT, would it be enough time to start a new GC processing, without having to go back home for a year?

just got my GC. Now if I contract for a security clearance job, like Armed forces, or Defense related one through the same employer that sponsored by GC, CAN I BE ELIGIBLE for a waiver of the 5 years waiting period -to what extent is is waived ....100% or only part of the 5 years wait, if at all .
My Company is a US Defense Vendor .
Can someone pt me to the right place where all this is clarified.
Also would the same kind of waiver apply if you work for a Govt agency or it is strictly defense...

My job title changed from programmer anaylst to technology and system anayst. This was an internal change in my company where they re classified everyone. My job duties remain exactly the same. My employer is also willing to write my job title as the old one on the employer verification letter.
However there is a slight problem. My recent pay stubs show my new job title. Nowhere else the old job title is mentioned..
will this be a problem?

I guess that is also H1B as H1B for non-profit organizations does not fall under yearly quota .they can get H1B anytime , so no need to wait til Oct.

Then AFTER you become a U.S. Citizen, she will be able to apply for I-485 Adjustment of Status and only at that time you will be able to apply for work permit. By the way. If the I130 is approved and she goes out of country and then tries to re-enter the U.S. on a B-2 visa, she may be denied entry based on Immigrant Intent, for which B1/B2 visa does not allow. Do some research.

I filed AP for me and my Dependent , Unfortunately USCIS just picked the application on the top of packet ( My Application ) and i got the receipt No , I dont know what happened to my Spouces Application her check is not cashed and no receipt no , I suppose her applicaiton is was just placed with my applicaiton and was considered as just one application .
Now what are my options , can i go ahead and file one more application , i know its literally impossible for me to call uscis and Track my wife's application , can i go and file a new application for my Spouse . Please advice.

You may work for any employer any hours you want with the EAD.
