Hi,
My wife has received the ASC notice of biometric appointment. But I did not. She filed as dependent of my concurrent I-140 + I-485 case. I am wondering if there is anything wrong. Should we receive the notice together? Or it is normal to have seperate appointments? Then how long could be the interval between the notices? Anyone in the same situation before? Could I find it out by Infopass appointment?

I think you should be ok as long as the I-140 isn't revoked. Green card is for future job and so you dont need to be currently working for them.

Hi, I have approved H1b through company "NewCompany" but my GC sponsoring company "GCcompany" is planning to cancel my APPROVED 140. Again, I know USCIS will do inted to deny and Yes, I have filed for 485 + it's been 180+ days but I guess the most important question of all is:-
"Will this affect my H1B status?' Since the approval for new 3 year (extension) was based on my 140 and now this thing is under jeopardy. If I use EAD, my wife will no longer be H4 and thats a different problem- Gosh when is thind going to end?"

Friends,
In preparation to file I485, we just had medical tests and the doctor checked the box " Applicant does not meet immunization requirements" in my son's report citing the reason insufficient dates.
What is the impact of this ? How this can be remediated ? Any suggestions by those who experienced similar situation would be greatly appreciated.

Hi Gurus,
Request your help on my query. I am on H1B with an I 797 valid upto 29-Jan-2011 and dependants have stamped H4 visas valid upto 29-Jan-2011. My company is in the process of applying for my H1B extension (this will be my second extension and i have currently completed 4 yrs 9 months in US).
My dependants are planning to travel to India at the end of this month and plan to return back by end of Nov. Will they face any issues during their return at POE ?
Will there be any complications with our visa extensions ?
Appreciate your response at the earliest.

I am working on AC21 under a company that is going to be bought over completely by another company at the end of March next year. The corporate attorney mentioned that effective 04/01/2010, my company will stop existing as a separate entity and all AC21 guys will need to re-file their AC21 with USCIS (of course, submitting AC21 is optional).
We are planning to visit India for a month or so (my wife might stay there for longer) in the beginning of March next year. We have a valid Advance Parole until 08/31/2010 to re-enter USA. We obtained this Advance Parole when I was still working with the employer who sponsored my I-140.
Some questions
-- Is it safe for us to come back to USA after March 2010?
-Or shall I first file AC21 with the new company and then, leave USA?
I am the primary applicant of our 485 application and my wife's 485 is dependent upon me.
Please let us know so we can plan our trip accordingly.

I think once the I-140 application is filed based on the state of residence, USCIS can transfer it to any service center. The applicant doesnt have any control over it. As far as I know, the applicant cannot request for a change in service center.

This is such an open ended question. It will be very easy to answer if you can add few lines about your background, affordability and qualification(like GRE etc). If not the school names will be all over the place from MIT to the ABC University....as the word "Good School" is very subjective.

This month dates are 22 Jan 2005.
