There is a mistake in my 485 cover letter. The letter states that I am EB3 but actually I am EB2.
Will this cause any problem? Will USCIS deny my case? Please note we included I-140 approval form in the file.

Hello,
I am from India and currently visiting USA on B2 visa. I recently got a job with a very reputed firm in US and applied for an H1B but my application reached USCIS after the H1B quota was full.
I really want to work for my new employer and would like to know what other options do I have to obtain work permit in USA other than L1 Visa?

If it is a non profit research org or institute of higher education then H1 will not be counted towards quota. On the other hand if you have the credentials you can try for "O" VISA

My wife is right now on H4 and having her EAD which will be expiring in another 2 months. She is not planning to work. Currently I am woking on H1B, soon I will be joing another employer on EAD. My question is it necessry for my wife to renew EAD even if she is not planning to use it. Once I swith on EAD what need to be done for my wife.

my fiancee is on H1 status and i want to change her status from H1 to H4 (H1 getting expired). will it be ok as long as i maiting H1 status?

I think he lieing. As long as you change the employer, you can file in the same EB category.

Hello ,
I recently changed my visa status from H4 to F1. I received my I-797 yestreday, and noticed that the I-94 attached with the I-797 has my birthdate printed wrong on it. I confirmed with my school, and they told me that there was a mistake in the I-539 application for change of status that I had filed, the birthdate was written wrong there. I also visited the local USCIS office and they told me they do not correct these errors and I need to send an application to the service center (california service center).
Please can anybody advice me as to what form do I have to fill, and how much time will this process take. I have got an oncampus job, in this case can I apply for a SSN with the I-797 with my birthdate mentioned wrong on I-94, my passport and my I-20 has the birthdate right. Also will there be any problem while my application to correct I94 is in process when I apply for my OPT since this is my Final semister in school

I am sure this has been discussed in detail before but I couldn't find the related threads..So i am posting it again..Sorry for the spam..
My wife converted from H4 to H1 last year (H1 started Oct 2007). She has been working for the H1 sponsoring employer since 10/1/2007...She plans to take a break now and relax for a few months for personal reasons...Can we update the I-9 form with her EAD info and work for a few days and then take a break...I know by doing this she will lose her H1 status but we are fine with that as she will be using her EAD moving forward...I am a July 2nd filer with 140 approved, so I dont see any risk in my I-485 as it is a pretty straightforward case...Have been with only 1 employer since Jan 2001 with PD: Nov, 2003 EB-3 India.
I just wanted to check if this is ok...Any thing that we need to look into before changing the I-9 to EAD....

My recent EAD renewal had issues with the validity dates so I sent both the EAD (mine and my spouse) for correction. I received my EAD back with dates corrected but not for my wife. I called USCIS and one nice rep sent an email to the EAD supervisor requesting action but this was only a week ago. My wife now has a job offer but she is unsure if she could proceed due to lack of a EAD. This is obviously very frustrating for her since it was so hard to find a entry level job in this economy
I got a infopass but only for next week and it will be a little too late for the new job. She has to report to work next week. Any suggestions/thoughts for a way out will be helpful. FYI 90 days have passed since my initial EAD renewal application. I am considering opening a SR but that has a time line of 60-90 days

I tried calling Nebraska Service Center using the 1-800 number and then entering the POJ options. But it seems USCIS has a new system in place and there's no way to reach the Service Center anymore.
Looks like they ended another means of communication---no more POJ? Please correct me, if someone knows the new options. Thanks!

I submitted 485 application for me (primary) and my wife (secondary); now she is changing her job before we can get the receipt for 485 filing....she is on h1B....the new employer will file her H1B transfer..........does anyone see any issue with this????
I think its fine as her H1 status is independent of we filing 485....any thoughts?

You can export the cube with only the outlines and then export the cube without the outlines and just the fill. Incorporate both animations into Flash, and you should be able to manipulate them both as you choose.
